April 2009 – the Supreme Court dismissed an appeal in cassation submitted by AS YIT Ehitus between local residents, the Tallinn City Government and the builder.
This is a court case related to the building and planning rights of the Sanatorium Park boarding house which deserved a large-scale attention from the media. Pursuant to a decision as of 01 April 2009 the judgment of the Tallinn District Court in accordance with which the building permit was revoked and a precept was issued to the Tallinn City Government for review of the issue of demolition of the constructed building remained in force.
Comment by Villu Otsmann, an advocate-at-law who represented local residents pro bono: First of all, the decision that has entered into force has confirmed that the protection of the human environment of local residents, particularly the ambience that has prevailed in the city park for years, is not only a value being protected at the discretion of political power, but local citizens have a specific right to require sustainability of their everyday human environment.
